Victory for Musina Council in court case

The Pretoria High Court has recently dismissed Sinky Makushu´s application to reverse the eviction order of residents of Extension 7, commonly known as Sehlalangenkani in Musina.
When certain population of Musina residents erected shacks at Sehlalangenkani under the leadership of the Greater Musina Unemployement Forum chairperson, Sinky Makushu, four years ago, the Musina Local Municipality took a legal route to evict the residents who claimed to have no roofs over their heads.
As a result, Makushu made an application through his legal representatives requesting the court of law to set aside the eviction order, but the court ruled in favour of the municipality. After receiving the eviction letter earlier this year, the municipality demolished the shacks at Sehlalangenkani.
According to the mayor of Musina, Cllr Caroline Mahasela, Makushu again requested the High Court to reverse the judgement. Mirror saw a copy from the High Court judgement where one of the statements read: "The application for rescission is dismissed with costs."
During an interview with Mirror, Mahasela said that as a municipality, they are relieved by the High Court ruling. "People think we were cruel and abusive, but the High Court judgement made it clear to everyone that we are not living in a banana republic, where things are done illegally and unprocedurally. This must serve as a lesson to our people that they must only interact with their ward committee members, councillors and community development workers, but not to those who are power hungry," she said.
Mahasela said that Makushu is the sole owner of the RDP house number 3765-56 at Matswale. "He had applied for the house, but he influenced others to do it in the wrong way. We did not take the legal route to make him poor, but to fast track our mandate of rendering proper houses to our people that we love," she said.
Her message to Makushu is that he must accept that he is not from the chief´s kraal, that he does not have land and people are fed up with his "cheap politics".
When contacted to comment, Sinky Makushu said he was not in a good position to comment about the High Court judgement as he was still going to discuss about it with his advocate.
