TSHITALE – Clament Nesengani (44), a teacher at the Edzisani Primary School, was sentenced to 30 days in prison or to pay a fine of R200 for assault with the intent to do grievous bodily harm, by the Tshitale Magistrate' Court last Friday.
This follows an incident that took place at the Tswika village in the Tshitale area, two days before the court date, at about 08:30. The court heard that on the day of the incident, the accused was busy delivering some lessons inside the classroom. At the time, the complainant parked his bakery truck outside the school premises, next to the nearby tuck shop. The accused ran out of the classroom and went to the tuck shop. On arrival at the shop, he confronted the driver in anger, accusing him of having a love affair with the accused's concubine, who stays at the Mulima village.
The complainant denied any knowledge of the accused's concubine, saying it was news to him. This resulted in the two being engaged in a heated argument. During the argument, the accused lost his temper and started assaulting the complainant with his fists.
The assistant driver intervened and managed to stop the fight. At that stage, the complainant was bleeding from the mouth and nose. The matter was reported to the police and the accused was arrested later that afternoon. The accused was released after paying a fine of R200.
