Radzuma brothers' murder case postponed, waiting for 'new facts'

Ms Luvhengo Musetsho, the wife of slain SAMWU member Timson Musetsho, is very frustrated with the slow progress and the latest postponement in the trial where the Radzuma brothers stand accused of killing her husband.

After the case was postponed on Monday, 22 April, Musetsho told the media that she was not hopeful that a positive outcome would be reached soon. Judge Legodi Phatudi, who presided over the matter, decided to postpone the case to 8 July. The case appeared in the High Court in Thohoyandou. Judge Thogomelani Tshidada, who had previously presided in the case, was not available.

“I still believe that even in July, the trial is not going to proceed because there have been too many postponements. I lost hope in the court of law and the law-enforcement unit at large because they are failing us. Each time there is a postponement, we get emotional and frustrated,” said Musetsho. She urged the judge to prioritize the case.

The three Radzuma brothers, Simon, Percy, and Ndivhuwo, surprised relatives, friends, and union members who attended the hearing when their legal representatives requested that the case be transferred to the Thohoyandou Magistrate’s Court as they intend to apply for bail based on new facts. Simon and Percy are charged with the murder of the two South African Municipal Workers Union (SAMWU) members, Timson Musetsho (50) and Ronald Mani (50), who were gunned down in separate incidents in 2019. Ndivhuwo, the elder brother of the two, is also a suspect in another murder case.

Advocate Ntsako Hlongwane, one of the legal representatives of the three, told the High Court in Thohoyandou that for the court to take into consideration the three’s intention to apply for bail, based on new facts, was vital.
